Article 1 - Purpose of the contract

the rental of an electric all-terrain bicycle or scooter with its basic equipment by TOURRETTES EVASION, hereinafter referred to as "the lessor".

Article 2 - Equipment for electric bicycles and all-terrain scooters

All electric all-terrain bikes or scooters for hire are equipped with basic equipment consisting of the following accessories: Electric assist system for electric assist bikes (motor, battery and console), anti-theft device, helmet, puncture repair kit for bikes, backpack on request.

Article 3 - Conditions for breakdown assistance for vehicles

Assistance during bike rental is provided by the rental company within a 30km radius of the rental company's depot; beyond this area, the renter must use a service provider of their choice.

Assistance is provided by the lessor only for all maintenance operations other than punctures where the lessee is unable to carry out the maintenance operation (electrical failure, tire blowout, broken chain... etc...).

In the event of a call from the tenant for a maintenance operation for which the lessor is not responsible; puncture or damage to the equipment preventing the continuation of the rental and for which the tenant is responsible, the lessor will charge the intervention at a rate of €40 excluding VAT per hour from the consideration of the request until the repair or replacement of the equipment.

For all-terrain electric scooters equipped with puncture-resistant tires, the lessor undertakes to intervene within a 30 km radius at its own expense if the lessee is not responsible, namely if the lessee has not entered a road unsuitable for the vehicle and outside the routes provided by the lessor or its depositary.

Article 3 - Effective date, availability and recovery

The rental agreement takes effect when the renter takes possession of the delivered equipment and accessories. Risk of loss or damage to the equipment and accessories is transferred upon delivery to the renter, who assumes full responsibility for them and agrees to use them with the utmost care in all circumstances. This agreement is valid only for the duration of the rental. If the renter retains the equipment beyond this period without having settled their account, they forfeit all the guarantees provided for in the agreement.

The tenant acknowledges having received the rented item in good working order with the basic equipment. He declares that he personally had full discretion to check the equipment and choose it according to his needs.

Article 4 - Payment and payment terms for the service

The tenant must pay for the entire service before departure. Accepted payment methods are check, cash, and credit card.

Article 5 - Use

The lessee certifies that they are capable of using the rented equipment and agrees to use it themselves. By express agreement between the parties, lending or subletting the equipment is strictly prohibited. By express agreement between the parties, the lessee is strictly prohibited from attempting to repair the equipment in case of malfunction. For any other reason, the lessee must immediately notify the lessor by telephone at +33 660 714 829.

The renter agrees to use the rented item carefully, without endangering third parties, in accordance with current regulations. The renter strongly recommends that the renter wear a helmet.

When parking equipment on public roads, it is mandatory for the renter to install the anti-theft device as indicated by the lessor: electric all-terrain bicycles or scooters must be attached to a fixed point that does not allow the removal of the rented vehicle.

In the event of theft of the equipment, the renter must notify the lessor without delay, file a complaint with the competent authorities and provide a photocopy of the complaint form.

Article 6 - Liability in the event of breakage - theft

The tenant has no guarantee for damage to the rented property except for electric all-terrain scooters and is personally responsible for such damage, breakage and theft.

However, the lessee cannot be held responsible for the damaging consequences of hidden defects in the rented equipment or of wear and tear that is not apparent and unsuitable for its intended use, provided that the lessee can provide proof of these defects or wear and tear.

In case of breakage, the renter agrees to return the damaged equipment, which must be identifiable and complete.

Damage to equipment will be charged and deducted from the deposit or paid directly to the lessor at the current rate attached to this contract.

Theft and loss of equipment are not covered. In these cases, the equipment will be billed to the renter based on its value, less a depreciation rate of 20% per year. In the event of theft by the tenant, misappropriation or any damage resulting from failure to comply with the rules of use or regulations in force, or the terms and conditions of this contract, the lessor is entitled to take legal action for total loss.

Article 7 - Security deposit or bank imprint:

When the equipment is made available by the lessor, a bank imprint is placed on the bank card provided by the customer, the value of which is mentioned on the rental contract, the amount of which depends on the equipment rented and the quantity.

This deposit or bank imprint is not cashed during the rental period.

Upon return of the equipment, the deposit is returned to the tenant, after deduction of any damage as provided for in article 6.

Article 8 - Return

The rented equipment must be returned at the time specified in the contract. For safety reasons, the renter agrees to notify the rental company of any impact to the helmets or damage to the equipment.

Article 9 - Expulsion of the lessor

The accessories supplied with the equipment must not be removed or modified by the lessee. The equipment may not be transferred or pledged as collateral. The lessee generally agrees not to grant any rights, real or otherwise, to the leased property to any person that could affect its use or limit the lessor's availability or full ownership.

Article 10 - Jurisdiction

In the event of a dispute relating to this contract, the competent court shall be that of the registered office of the lessor's company, to which the parties grant exclusive jurisdiction.
